Article 1 — Purpose
These Terms of Use (the "Terms") define the conditions under which users may access and use the World Championship for Energy Savings (WCES) platform (the "Platform"), operated by A4MT (Action For Market Transformation).
By creating an account or using the Platform, users agree to be bound by these Terms.
Article 2 — Description of the Platform
The WCES Platform is a digital benchmarking and recognition system designed to :
- collect and analyze building energy performance data
- benchmark buildings based on measured performance
- support the establishment of national energy leagues
- identify top-performing buildings at national and international levels
- enable recognition and awards, including at international events (e.g. COP)
Article 3 — Definitions
- User : any individual accessing the Platform
- Client : any organization registering one or more buildings
- Building : any asset submitted for evaluation
- Data : all information submitted (energy, technical, administrative)
- Platform : the WCES online system
Article 4 — Access to the Platform and Account
Access to the Platform does not require the creation of a user account. Instead, users are granted access through a secure, unique submission link provided by WCES (e.g. via email). This link allows authorized users to submit and manage building data for a specific application.
Users are responsible for :
- maintaining the confidentiality of the submission link
- ensuring that only authorized persons access and use the link
- verifying the accuracy of any data submitted through it
Any action performed via the submission link is deemed to have been carried out by the authorized recipient.
Article 5 — Registration and Eligibility
The Platform is intended for :
- public or private organizations
- asset owners, operators, or managers
- entities authorized to submit building performance data
Users must ensure they have the legal authority to submit the data and represent the building.
Article 6 — Data Submission and Accuracy
The Client represents and warrants that :
- all submitted data is accurate, complete, and verifiable
- data is based on real measured performance (e.g. metered data)
- appropriate rights and permissions have been obtained
The WCES reserves the right to :
- request supporting documentation
- verify or audit submitted data
- reject or invalidate submissions in case of inconsistency or fraud
Article 7 — Methodology and Benchmarking
The WCES applies a standardized methodology to :
- calculate energy savings or performance indicators
- compare buildings across categories or geographies
- establish rankings or performance levels
The methodology may evolve over time and is described in dedicated documentation.
Article 8 — Publication of Results
By default :
- publication of results is optional and subject to Client consent
- anonymized or aggregated data may be used for analysis
If publication is authorized, WCES may :
- disclose building performance
- include results in reports, rankings, or public communications
- showcase buildings at international events (e.g. COP)
Article 9 — Data Protection
WCES processes personal and technical data in compliance with applicable data protection laws (including GDPR).
In line with standard principles :
- data is collected for specific purposes
- only necessary data is processed
- data is stored securely
- retention is limited
These principles reflect standard GDPR requirements such as lawfulness, transparency and data minimization.
Article 10 — Use of Data
The Platform may use submitted data to :
- calculate building performance
- generate rankings and benchmarks
- produce anonymized insights and reports
- support policy development and research
Data will never be sold to third parties.
Article 11 — Intellectual Property
The Platform, including its methodology, algorithms, content and branding, is the exclusive property of the WCES / A4MT (Action For Market Transformation).
Clients retain ownership of their data but grant the WCES a non-exclusive license to :
- process
- analyze
- use for communication (if authorized)
Article 12 — User Obligations
Users agree to :
- use the Platform in good faith
- comply with applicable laws
- not misuse or attempt to disrupt the Platform
Article 13 — Liability
WCES operates under a best-efforts obligation.
The Platform :
- does not guarantee uninterrupted availability
- is not liable for errors resulting from incorrect data
- is not responsible for external system failures (e.g. metering systems)
Article 14 — Suspension and Termination
WCES may suspend or terminate access in case of :
- breach of these Terms
- fraudulent or misleading data
- misuse of the Platform
Users may delete their account at any time.
Article 15 — Data Portability
Upon request, Clients may :
- export their submitted data
- request deletion, subject to legal constraints
Article 16 — Changes to the Terms
WCES may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
Article 17 — Governing Law
These Terms are governed by French law. Any dispute shall fall under the jurisdiction of the courts of Paris.
